1. INTRODUCTION
This end-user agreement and the privacy agreement, together with terms and conditions and all policies uploaded and published on the official portal of QONOZ have been developed in order to protect and maintain the rights of both Manarat Al-Holoul Information Technology Co. incorporated in QONOZ Website on one hand and the End-User on the other hand, who may reach the website with or without registration or the Client attracted by Ads., regardless of registration.
The current agreement has been developed in accordance with the E-Transaction Act. Terms and Conditions stipulated herein together with disputes and conflicts shall be subject to laws and regulations enforced in the territories of Saudi Arabia.
As being an End-User, the same agrees to fully comply with all provisions set forth hereunder in case of use of website, a visit to the official portal, or registration in the service. Without prejudice to the aforementioned, QONOZ Website, at any time, may have the right to make alterations and amendments to this agreement. Such amendments shall be considered binding to all parties after an update notice on the website or by any other means.
2. DEFINITIONS
Manarat Al-Holoul Information Technology Co. – is the official proprietor of QONOZ Website. It is a duly established Saudi corporate (100 %) based in the city of Jeddah. It is a digital platform by which the end-user (creator of the account) could be able to afford its services and deliver so to the intended client (receiver of the E-account) in accordance with predetermined terms and conditions – referred to hereinafter in this agreement as ‘Manarat Al-Holoul Information Technology Co.’, ‘We’, ‘Us’ or ‘QONOZ Website’ – representing ‘First Party’
User: means the person, corporate or firm creating the E-account reaching to the website; and take benefit of services, directly or indirectly – referred to hereinafter as ‘Member or Second Party’
Client: refers to the entity (individual, corporate, firm) to which the E-account ends, targeted by the End-User (who creates the E-account)
E-Account: refers to the data created, saved or transmitted by the User (who created the E-account) and may be in the form of service afforded, service solicited, responses, or private messages
3. TERMS OF USE
As being the Second Party to this agreement, approval to benefit and use of services afforded by the website, you are committed NOT to do the following:
3.1 To advertise or download content or items that are inappropriate for the ratings available on the site that are permitted to be sold. You should review the terms of the advertisement and prohibited products.3.2 To breach or circumvent the laws, policies and regulations of the site or any rights related to the third party.
3.3 To copy the advertisement from the Qonoz website and re-publish it on other sites.
3.4 To use any illegal means to access advertisements or other users' data, violate the policy and rights of the Qonoz website, or access the content of the site, or collect information and data related to the Qonoz site or the site’s Clients and benefit from them in any way or re-publish them.
3.5 To use our services if you are not legally qualified to complete this agreement. For example, you are under the age of 18, or that you are temporarily or permanently blocked from using the site.
3.6 To tamper with product prices, whether in buying or selling, and to harm other users.
3.7 To post false, inaccurate, misleading, deceptive, defamatory advertisements or comments.
3.8 To be exposed to international policies, sovereignties, respected personalities, or any discussions that are not related to legitimate buying and selling on the Qonoz website.
3.9 To transfer your account or your activity to other sites while it carries the logo or services of the company.
3.10 To infringe copyrights, trademarks, patents, advertising, databases or other property or intellectual rights belonging to Manarat Al-Holoul Information Technology Co. or licensed to the company that owns the Qonoz website.
3.11 To violate the rights of others, IPR’s or patent.
3.12 To advertise tobacco and smoke products (these products expose you to obtaining a violation by the competent authorities)
3.13 To violate the laws and rights applied and enforced in the territories of Saudi Arabia.
3.14 To collect information about other site users for commercial or other purposes.
3.15 To do anything that would damage the reputation of Manarat Al-Holoul Information Technology Co.
3.16 To impersonate Manarat Al-Holoul Information Technology Co. that owns the Qonoz website, or a representative thereof, or an employee therein, or any capacity that suggests that you are affiliated with the company unless you have official permission from the company.
3.17 Such a service may not be used by any inhuman user – except for those affiliated to the following corporations:
Failure to abide by the above-mentioned terms and conditions may render Manarat Al-Holoul Information Technology Co. having the right to suspend or terminate your membership; deny access to the site without prior notice. Under this agreement, you acknowledge and undertake not to use the website unless after having the website’s relevant consent.
4. LIABILITIES OF QONOZ WEBSITE
Manarat Al-Holoul Information Technology Co. provides service(s) to enable the user to display his products on its website (Qonoz) in accordance with the agreed use policy. We do not provide any guarantees and we do not bear any responsibility in the event that the user does not adhere to the site use policy and we are not responsible for any risk, damages, consequences or losses incurred by the seller, buyer or any other party, and whoever suffers the damage must inform us of this through a link to contact us and explain the damage caused to him, and the Qonoz site management team will take action according to the type of incident without any liability.
Your use of Qonoz website means that you authorize us to save your data that you entered on the organization’s servers and we have the right to view and review it. You also agree to our right to monitor private messages when needed to ensure that they are free from violations of the usage agreement, and we have the right to delete the advertisement and dispose of the attached pictures when needed. The circulars, decisions, and directives of the site’s management and supervisors are binding and productive of all their regulatory effects to the second party after they are communicated to him via the site’s private messages, mobile phone, e-mail, or through the notifications system, and he must abide by them and act accordingly.
5. MEMBERSHIP CONDITIONS
Membership is the username registered in the Qonoz website and interconnected to its cellular number. Membership shall be subject to the following terms and conditions:
5.1 A proper suitable name should be chosen during the registration process. 5.2 Use of more than one membership on the site is prohibited for each person or entity.5.3 You must update your mobile number associated with the membership in the event that your mobile number is changed or lost.
5.4 If your membership name contains a trade name or a trademark, you must be the owner of the trademark or be authorized to use the name or trademark.
5.5 No sale or assignment of the membership may be permitted to the third party or allow any other party to use it. The first member of the membership is responsible for it for any violations or legal responsibilities, and both parties in the event of sale or assignment will be considered violating the use policy of the Qonoz site. A member is obligated not to share his membership information with anyone.
5.6 "Qonoz site" is committed to taking the necessary standards to protect and preserve data, bearing in mind that the Internet is not a 100% safe way to preserve confidential information. (See the privacy policy).
5.7 The service exchanges some information with your device for the purpose of providing the service to you.
5.8 The site uses statistical programs such as Google Analytics to develop and improve the service.
5.9 Customer data can be used for analytical purposes.
5.10 Qonoz site has the right to cancel or block any customer who violates the terms and conditions with no financial reimbursement.
6. PRECONDITIONS FOR CONTENT ADDITION TO THE WEBSITE
Under approval of using the services afforded by the website, you undertake the following:
6.1 Not to announce any prohibited product on the site.6.2 Not to add any prohibited responses to the site.
6.3 Not to send any prohibited messages to the site.
6.4 Determine the selling price of the advertised product.
6.5 Follow up on your adv. and respond to Client inquiries through responses or through private messages.
6.6 Adhere to the duplicate ads policy.
6.7 Advertising material must be a product or service only.
6.8 Advertisement must be fully detailed and in the correct section.
6.9 The site has the right to delete any adv. without providing any justifications to do so.
6.10 Copying any adv. from the site is prohibited.
6.11 If you provide a service or sell a product that requires a permit, such as providing commenting services, you must have the necessary permits for this.
6.12 The advertiser is obligated that the images added in the adv. are the same as the advertised product.
6.13 Content images must be morally appropriate and of high quality and do not violate the regulations of the Ministry of Labor or Human Rights or any government or private agency.
6.14 The advertiser is obligated not to add more than 5 ads on the site for the same product.
6.15 A commitment must be made not to advertise the products and services that fall into the list of prohibited products and services. It is also necessary to adhere to the list of prohibited responses and messages.
6.16 Alteration and update of the adv. is subject to all the terms and conditions hereunder this agreement. The user is responsible for any violations that occurred during the creation of the advertisement or after update or alteration thereof.
6.17 Creating, updating and modifying the user's responsibility (the creator of the electronic record).
7. PROHIBITED PRODUCTS
The products shown below are the products prohibited to be displayed on the website. These products are banned and may not be advertised on the site. Purchase such banned products on the site is also prohibited. The Management has the right to prohibit the advertiser who advertises these products and prohibit those who respond to him through private messages or through replies. Please note that there is no warning before the ban, and that the ban is subject to the discretion of Qonoz website management.Following are the banned products:
7.1 All products prohibited according to the laws and regulations of Saudi Arabia.7.2 Installments and banking products. These products are prohibited even if they are considered legitimate.
7.3 Medicines and medical and health products. These products are prohibited even if they are permitted by the laws of the Ministry of Health and even if they are products recommended by the Ministry.
7.4 Network Marketing: Any type of network marketing is strictly prohibited, regardless of its type, description or method.
7.5 Weapons, including detonators, pistols, machine guns, personal protection weapons and their accessories, even if they are licensed.
7.6 Sexual products in all their forms and types.
7.7 Stocks, portfolio management, currencies, marketing and all related matters.
7.8 Lasers, spy and eavesdropping devices.
7.9 Sites, forums, electronic services, e-mails, and selling memberships and programs.
7.10 Selling any items is free. An example is email, Twitter and Instagram accounts, and others.
7.11 Products that infringe on IPR’s, for example, copied programs and copied films.
7.12 Tobacco products
7.13 Advertise products or services that require a license without obtaining a license from the organizer.
7.14 Prohibited devices such as jamming devices, encoders, or mobile signal boosters.
7.15 Devices with security risks
7.16 Advertise calling cards or telecommunications services without obtaining the necessary licenses and without submitting them to the site’s licensing system.
8. BANNED ADVERTISEMENTS
Following is the list of most common techniques and advertisements banned on the site:8.1 All ads not related to purchase and sale
8.2 Advertising in order to add a suggestion or discuss a problem with the administration on the site. The ads are intended for sale and purchase only.
8.3 Adding advertisements for suggestions to develop the site in the exhibits that harm the advertisers’ ads on the site. The best way to suggest or complain is to contact us via the Contact Us form.
8.4 Incomplete details of advertisement
8.5 Addition of an image that is not for the same product
8.6 Deception by adding pictures of an item other than the one shown. For example: An advertiser announces the sale of a used gold bracelet and displays an image of a brand new one of the same type.
8.7 Any advertisement containing reference to any racist matter in all its forms.
8.8 Any advertisement that contains misleading information in detail other than the main title.
8.9 Adding an advertisement for the purpose of defamation. If you have a complaint against our advertiser, please contact us at the following mail: (contactus@qonoz.com) and clarify the problem. Complaints outside the jurisdiction of the site management shall be submitted to the relevant authority in Saudi Arabia
8.10 Adding an adv. title that contradicts the content of the advertisement, (e.g., when a seller announces jewelry and writes in the title: a diamond necklace and puts in the detail data for another product such as a gold bracelet)
8.11 Copying an advertisement for another advertiser or part of it.
8.12 Donation announcements and assistance requests. The state system prohibits donation and charitable work outside the specific legal scope allocated for this.
8.13 Soliciting and assisting beggars to seek nepotism and assistance. The site administration has the right to (block / freeze) the account of the member who helps beggars on the site.
8.14 Ads that contain abuse of power

11. SECURITY POLICY OF QONOZ WEBSITE
Administration of Qonoz Website is committed to the use agreement and privacy of use. However, we are not a party to any dispute or issues that arise between users for violating one or both of the usage agreement. Rather, it seeks to enhance the security aspect of the site in order to limit and eliminate the infringements made by some of the site's users in a way that violates the agreement, policy, privacy and terms of use, in order to achieve the integrity of buying and selling, fighting fraud and deception, and in compliance with the laws, legislations and regulations enforced and applied in Saudi Arabia. Accordingly, Manarat Al-Holoul Information Technology Co. is hereby entitled to take the procedure necessary against any person, corporate or firm deemed in breach to the provisions set forth under the Use Agreement – knowing that such procedures may be stepped up to legal and judicial prosecution before the relevant competent authority(ies). Below are the common violations and the necessary action.
11.1 The Client has been exposed to a fraudulent act by another: the client must inform the competent security authorities. The client must also fill in the complaint form for this on the Contact Us page. The site administration will review the complaint and investigate the defendant, and the necessary action will be taken against him/her in case it is confirmed that s/he violated the Use agreement. The site will not be a party to such issues and does not bear any responsibility, but we will provide what we have to the competent authorities in the event this is requested in an official capacity.11.2 Encroaching the policy or sovereignty of the state: In such a case, the advertisement will be deleted, the advertiser's membership will be suspended, and the competent authorities will be notified.
11.3 In the event that any of the prohibited products are announced: the announcement will be documented, archived, deleted, the member suspended, and the competent authorities notified.
11.4 In the event that a person, corporate, or firm unlawfully (e.g., hacking or using illegal data collection methods or any other means) in order to access the site’s content or codes of the site or the site’s databases or information and data related to the site’s Clientele in order to copy advertisements, re-publish or utilize them in any way, Manarat Al-Holoul Information Technology Co. shall then approach the competent authorities to prosecute the other party for alleged hacking and committing a cybercrime under the rules and regulations of Cybersecurity and Cybercrime Regulations.
11.5 In the event that a person, corporate, or firm proceeds to copy advertisements from the Qonoz Website for selling gold and jewelry to another site, the site admin. team shall then approach the competent authorities to file a lawsuit and prosecute the other party for the alleged infringement of the corporate rights. 11.6 Infringement of property, IPR’s, or patent rights of a third party: If you believe that one of your rights has been infringed, you must fill out the complaint form regarding the infringement of rights and provide evidence of the infringement in the published ad. The site admin. Team of Qonoz will review the complaint, verify its validity and will take the necessary action according to the result. You must go to the relevant authorities if you wish to sue the party that violated your rights. Note that Manarat Al-Holoul Information Technology Co. will not be a party to the case and is not responsible for it, and we do not bear any responsibility.
11.7 In the event that the second party makes a false assessment of another member, both members will be suspended and prevented from using the site if it becomes clear that they have been in collaboration to do so. All necessary actions will be taken for any consequences that occurred as a result of this assessment.
11.8 Exposure to Defamation and Privacy Breach: The client must fill out a complaint form specifically design for such a purpose. The site admin. will review the complaint and investigate the defendant; and the necessary action will be taken against him. In the event that it is confirmed and proven that s/he violated the use agreement, the client who suffers the damage must approach the relevant competent authorities to file a complaint. Manarat Al-Holoul Information Technology Co. will not be a party in such cases and bears no responsibility. However, we will provide the necessary information to the competent authorities if this is requested in an official capacity.
11.9 Nuisance: When a client is harassed by another, s/he must notify the site about such incident. The complaint will be duly investigated; and appropriate action will then be taken in this regard.
12. PRIVACY POLICIES
12.1 Privacy and Information Confidentiality: We appreciate your concerns and concerns about the privacy of your data on the Internet.
